| Abstract: | 本論文著眼於違反我國勞動基準法有關工時強行規定之行政裁罰。以我國電信業者、壽險業者之案例引出題旨,並以違反工時強行規定行為之行為數究竟如何認定、違反強行規定之法律效果罰鍰如何裁量兩部分,參考學說及實務進行討論,最後提出值得改進之處並提出結論。 This paper focuses on penalties for employer violations of mandatory provisions under Taiwan's Labor Standards Act. Using case studies from Chunghwa Telecom Co., Ltd. and life insurance sectors to illustrate the main issues, it examines two aspects: how to determine the number of violations of mandatory provisions and how to adjudicate fines for such violations. The discussion incorporates both scholarly perspectives and practical applications, and concludes with possible solutions. |
