Abstract: 本論文探討網路交易契約中標價錯誤之法律爭議,研究重點聚焦於商品標價頁面之法律性質及標價錯誤意思表示之撤銷問題。由於網路交易之普及,企業面臨標價錯誤引發的大量消費爭議,本研究首先探討網路交易的定義、類型及相關法律規範,並分析網路交易契約的成立方式、商品標價頁面之法律性質,本文以為,商品標價頁面的法律性質應視商家類型而定,並以頁面完整度、商家履約能力及消費者信賴利益存在與否作為標準進行判斷。本文隨後就自動化資訊系統之法律定位、企業用以杜絕消費爭議之網站使用條款效力及主管機關因應爭議所制定相關子法之立法實效進行研究,細為探究標價錯誤中契約成立層次之相關爭議。此外,本文深入研究標價錯誤的法律效果,探究企業能否根據民法撤銷錯誤意思表示及與消費者保護法相關規範之互動,並參酌比較法例進行研究。最終,本文借鑒他國立法例並提出建成我國相關法制的芻議,主張應考慮修訂相關法律,明確商品標價的法律性質及錯誤處理機制,以提升法律之可預見性和有效性。
This thesis explores the legal disputes arising from price misquotations in online transaction contracts, focusing specifically on the legal nature of product pricing pages and the rescission of erroneous price indications. With the proliferation of online transactions, businesses face a significant number of consumer disputes triggered by pricing errors. This study first examines the definition, types, and relevant legal regulations of online transactions, and analyzes the formation of online transaction contracts and the legal nature of product pricing pages. The paper argues that the legal nature of a product pricing page should be determined by the type of business involved, using the completeness of the page, the company's ability to perform, and the presence of consumer reliance interests as criteria for evaluation.
Subsequently, the study investigates the legal positioning of automated information systems, the effectiveness of website terms of use employed by businesses to prevent consumer disputes, and the legislative efficacy of sub-laws enacted by authorities to address these disputes. It delves into the controversies related to the formation of contracts in cases of pricing errors. Additionally, the paper thoroughly examines the legal effects of pricing errors, exploring whether businesses can rescind erroneous declarations based on civil law and the interaction with consumer protection law regulations, while incorporating comparative legal analysis.
Ultimately, the thesis draws on international legislative examples and proposes preliminary suggestions for improving the relevant legal framework in Taiwan, advocating for amendments to clarify the legal nature of product pricing and error-handling mechanisms to enhance legal predictability and effectiveness.
