Abstract: 本通訊保障及監察法於103年應積弊與時事脈動而修,修法內容以以下六大項目為主要內容:

一、一人一票、每十五日做成報告
二、調取通聯紀錄及通信使用者資料採法官保留
三、續監時間與事後通知
四、通訊監察過程中獲悉他案事證之證據能力有所限制
五、對通訊監察執行方法之管制
六、賦予法院監督職權

本研究為瞭解上開修法內容所產生之影響,以文獻分析法為始,瞭解修法之原因與脈絡,續以比較分析法將他國通訊監察法制為比較對象,最後以深度訪談法為主要研究方法,參考我國通訊監察之各機關聲請比例,邀請7位曾執行過103年修法前後通訊監察之第一線執法人員為訪談對象,彙整分析渠心得後,加以論證並提出未來修法建議。
The Communication Security and Surveillance Act was amended in 2014. The amendments primarily focus on the following six major parts:

1. One person, one vote, with reports submitted every fifteen days.
2. Judicial retention of access to communication records and user data.
3. Extension of surveillance duration and post-surveillance notification.
4. Limitations on the admissibility of evidence obtained during communication surveillance.
5. Regulation of the execution methods of communication surveillance.
6. Granting the courts supervisory powers.

This study aims to understand the impacts of these amendments by employing a literature analysis to comprehend the reasons and context behind the legislative changes. And a comparative analysis is conducted by examining the communication surveillance laws of other countries. Finally, in-depth interviews with seven frontline law enforcement officers who have implemented communication surveillance before and after the 2014 amendments are conducted as the primary research method. By considering the proportion of applications made by various agencies for communication surveillance in Taiwan, the study collects and analyzes their insights and experiences. Based on the findings, the research provides arguments and proposes future legislative recommendations.
