Abstract: | 2011年11月《社會秩序維護法》修法,在各方利益權衡之後,針對性交易的管制採行專區制度。修法至今已逾十年,合法設置的性專區卻仍付之闕如,導致性工作者沒有合法從事性交易的空間。地方政府對於性專區的設置敬而遠之不代表性交易就此消失,事實上臺灣各縣市早已「滿城春色」。
實體性專區以公共空間為載體,有其設置上的困難。除了法律學者對此撰文論述,社會學者、公衛學者亦有豐富的田野調查以及深度訪談可供參考。本文以跨學科的視角,試圖分析實體性專區所面臨的困境,包括:鄰避效應、污名標籤、制度容量、距離限制。藉此檢視實體性專區何以不適合作為臺灣脈絡下性交易管制政策的理由。 本文主張,在空間觀點下,權力間的鬥爭、論辯與調和會影響空間的規劃方式,空間的呈現結果則會影響到權利的承認與落實。實體性專區正是權力動態互動過後產生的空間規劃方式,而此管制政策所面臨的四大困境影響空間的呈現結果,性專區的不備導致性工作者合法從事性交易的權利被壓縮至零。本文認為,完整的性交易流程可以分為「媒合階段」與「性交易階段」,實體性專區是將兩階段同時放在公共空間中進行管制,但事實上性交易產業的發展趨勢是將「媒合階段」移至網路空間中進行,本文稱此種虛擬媒合平臺為「虛擬性專區」。在虛擬性專區的構想下,性交易過程不再是「從公共空間到私密空間」的流動模式,而是「從網路空間到私密空間」的流動模式,簡言之,性交易可以退出公共空間而回歸私密空間。不同於實體性專區「集中才合法」的管制模式,虛擬性專區目的在使原本「分散而違法」的性交易管制實況,變為「分散且合法」,並降低實體性專區四大困境的影響。虛擬性專區的倡議是為了替實體性專區的困境解套,使性交易管制政策可以真正得到落實,並真正「賦權」性交易雙方。 Social Order Maintenance Law (SOML) was amended on November, 2011. After discussing, the government decided to use “zoning policy” to regulate the sex trade. It’s been over ten years since the SOML was amended, but the red-light districts still don’t exist in any parts of Taiwan, resulting in sex workers cannot engage in sex trade lawfully. In fact, if we observe the industry of sex trade mindfully, sex trade has already scattered in many parts of Taiwan. Due to being established in public space, red-light districts have to confront plenty of plight. Expect literatures written by jurists, field researches and in-depth interviews from sociology and department of public health also offer abundant resources for us to depict the sex trade industry more authentically and vividly. Thus, this thesis uses interdisciplinarity as method to analyze the plight of red-light district, including: Not in My Backyard Syndrome, Stigma, the Capacity of the Institution and Minimum Distance Requirements, to examine why policy of red-light district is not the best choice to regulate the sex trade especially in the context of Taiwan society. This thesis argues that the collision, debate and conciliation between the powers will have an influence on the “policy of spatial planning”. Next, the policy will affect the recognition and implement of the rights. Policy of red-light district is a result of dynamic interaction between the powers. Four predicaments of red-light districts make setting a red-light district almost an impossible mission to carry out, which causes “sex worker’s right to engage in sex trade” to shrink. This thesis divides the whole process of sex trade into two parts, including “phase of matching” and “phase of sex and trade”. The policy of red-light district intends to regulate two phases in the public space, but the truth is the “phase of matching” is marching toward cyberspace via virtual platform, which I called “virtual red-light district”. Under the concept of virtual red-light district, the mode of sex trade doesn’t transfer from the public space to the private space anymore, but form the cyber space to the private space. Simply put, the whole process of sex trade can be removed out of public space, and completely happen in the private space. Not like policy of red-light district trying to concentrate the sex trade in a specific space and making it lawful, the policy of virtual red-light district aims to turn current sex trade reality from “scattering and unlawful” into “scattering but lawful” and mitigate the impact of four plight of red-light district. The proposal of the virtual red-light district is to practically find a solution to the predicaments which the policy of red-light district face. Only the regulating policy of sex trade be implemented that can make the sex workers and consumers truly empowered. |
