Abstract: 網路團購為近年來相當熱門的網路交易模式,自2008年美國Groupon團購網成立後,網路團購熱潮迅速擴及到世界。2010年台灣百萬網友團購網以同樣的商業模式,開啟台灣的網路團購市場。網路團購之特色在於團購券之使用,然而團購券雖帶給消費者新鮮感卻也增加法律關係的複雜性及給付的不確定性。
本文嘗試從團購券之法律性質開始,逐步分析團購網站、店家與消費者三方當事人間之法律關係與契約類型,以期對此新興之商業模式有更進一步的了解。並針對網路團購於我國現行消費者保護法消費者無條件解約權相關規定適用上所生之疑義,透過比較法的觀點,試圖建構更完善的規範方式。
The advent of e-commerce and its related technologies have led to the creation of many new and interesting online business models.Daily Dealis one of the most well-known and popular online business models, which hastaken off worldwide over the past few years. Taiwan has also caught up with thetrend.
One of the distinguishing features of Daily Deal business model is the using of electronic vouchers, which give the consumera novel shopping experience.However, the vouchers also increase the uncertaintyof receiving the goods or service and the complexity of related legal issues.This thesis introduces the legal nature of vouchers, and from the legal interpretation of the Civil Code, clarifying the law relations among Daily Deal websites, merchants and consumers.
Since online transaction is one of typical types of mail order purchase in Con-sumer Protection Law, the Daily Deal consumer has a period of 7 days to withdraw from the contract, without giving any reasonand without incurring any cost. However, Daily Deal websites through the using of vouchers provide many new and different types of goods and service, which may cause some question when applying the articles. Through comparing with European Union Directive on consumer rights, the thesis tries to find an adequate regulation mode for Consumer Protection Law.
