Abstract: 隱私權乃人發展人格所必要之基本權利,然而在Web 2.0年代鼓勵使用者參與,社群網站興起之後,更強烈鼓勵「分享」之概念,造成了「過度分享」,個人資料大量暴露於眾人面前,引起使用者相互之間隱私權侵害,以及使用者侵害第三人隱私權之問題。然而,我們可以發現真實空間中之隱私權理論面對網路空間中及社群網站使用者之隱私權問題時,無法完全解決問題。本文藉由解釋「隱私之合理期待判斷準則」,以「隱私權之情境脈絡完整性理論」作為概念之填充,希冀對於社群網站使用者之隱私權有周全之保障,也能促進眾人在使用社群網站時,對隱私權之重視。
Privacy is necessary for the development and formation of selfhood and the protection of human dignity and is thus a constitutional protected right. Nonetheless, privacy is at risk following the rapid evolution of information technologies. Developers of websites and those commercial firms encourage Internet users to participate in creation of knowledge on the web in the age of Web 2.0. Social-networking services even encourage users to share more information. This phenomenon has been called “over sharing.” This thesis argues that traditional privacy theories focused on the physical space cannot solve privacy problems existing in the cyberspace. Although this thesis is still using the “reasonable expectation of privacy test” to decide whether the privacy in question exists or not, it, nonetheless, proposes that the test should be interpreted by using “privacy as contextual integrity theory” in order to give the users of social-networking sites a reasonable protection of their privacy.
