不實核銷研究費案之刑法公務員探討

Abstract

首先，本文將藉由文獻資料之蒐集與分析，探討現行刑法上「公務員」之定義。其次，將就實務判決，在法律之適用及解釋上，提出本文之疑慮以及批判，以維持法律之安定性及明確性。最後，在不同行為態樣下之不實核銷案，亦應有所區別而須分別加以探討，並不可一概而論。 關鍵字: 公務員；法律解釋；法律適用；法安定性；法明確性

This research firstly collects and analyzes the literature and discusses the definition of 'civil servants' under the present criminal law. Then, this research aims at the related judgments and submits our concerns and criticism based on the application and interpretation of the law, for purpose of maintaining the stability of law and legal certainty. And finally, this research finds different verification styles should be distinguished and be treated separately.
