摘要: | 我國公寓大廈管理條例施行迄今已近三十年,在有關於作為公寓大廈中意思決定機關之區分所有權人會議之研究中,雖有論者針對特定議題撰寫文獻,但仍缺乏一統整性之文獻,整合區分所有權人會議之相關爭議。因此,本論文係以區分所有權人會議為研究重心,除實務判決爭議之探討外,亦輔以日本建物區分所有法作為比較參照之對象,透過二國法制之比較與檢視,探尋出我國法值得檢討之處。
本論文第二章係闡述自治管理之重要性並概述我國公寓大廈管理條例與日本建物區分所有法之立法背景。本論文第三章則是介紹區分所有權人與管理委員會之法律定位,藉由實務判決與學說之整理,突顯出現行法下管理委員會之矛盾所在,並提倡應仿照日本法承認區分所有權人團體之概念。 而本論文第四章與第五章則聚焦於區分所有權人會議之相關問題。其中,第四章係針對區分所有權人會議之程序部分,即針對區分所有權人會議之召集程序與決議程序為介紹。第五章則探討區分所有權人會議之效力部分,首先檢視區分所有權人會議與規約之互動關係,再審視有關區分所有權人會議決議之拘束效力範圍,最末再檢討具瑕疵之區分所有權人會議決議之效力。 Condominium Administration Act Building Administration Division has been implemented for nearly thirty years in our country's condominiums. In the research regarding the Unit Owner Assembly, which serves as the decision-making body within condominiums, although some scholars have written literature on specific issues, there is still a lack of comprehensive documentation that integrates the relevant disputes concerning the Unit Owner Assembly. Therefore, this thesis focuses on the Unit Owner Assembly and, in addition to discussing practical dispute resolutions, also refers to the Japanese Act on Building Unit Ownership for comparison. Through a comparative analysis of the legal systems of the two countries, it aims to identify areas in our country's laws that are worthy of review. Chapter 2 of this thesis elucidates the importance of self-governance and provides an overview of the legislative background of the Condominium Administration Act Building Administration Division in our country and the Act on Building Unit Ownership in Japan. Chapter 3 of this thesis introduces the legal position of unit owners and the management committee, highlighting the contradictions within the current law through the compilation of practical judgments and academic theories. It advocates for the adoption of the concept of the Association of Unit Owners, similar to the recognition of unit owner groups in Japanese law. Chapter 4 and Chapter 5 of this thesis focus on the relevant issues concerning the Unit Owner Assembly. In Chapter 4, the procedures of the Unit Owner Assembly are examined, specifically the introduction of the convocation procedures and decision-making procedures of the Unit Owner Assembly. In Chapter 5, the effectiveness of the Unit Owner Assembly is explored. Firstly, the interaction between the Unit Owner Assembly and the Condominium regulations is examined, followed by an examination of the scope of the binding effect of decisions made by the Unit Owner Assembly. Lastly, the effectiveness of decisions made when the meeting process of the Unit Owner Assembly has flaws is reviewed. |
