摘要: | 在科技快速發展下,臉部辨識的運用已滲透到社會、生活的各個層面,惟所涉及隱私權、人格權、偏見歧視的疑慮,特別是對於職場上相對弱勢的勞工而言,影響更是深遠。然而我國法制尚未完備,正視臉部辨識等新興科技帶來的挑戰,是法制必須面臨的課題。本文介紹美國法有關法制,其中涉及規範,可分為:資料隱私、生物特徵資料隱私及與新興科技有關。目前法規主要在隱私、課責及勞工權益保障,論者也提出應該透過制定專法,重拾勞工資訊自主權並提供教育協助方為保障勞工之道,且不宜以告知同意作為唯一的保護的機制。而美國法的討論,亦可作為我國立法與政策參考。 With the rapid advancement of science and technology, facial recognition technology has permeated various facets of society and daily life. Concerns regarding privacy rights, personality rights, and prejudice and discrimination have far-reaching implications, particularly affecting relatively disadvantaged workers in the workplace. The legal system is not yet fully equipped to address the challenges posed by emerging technologies such as facial recognition. Therefore, it is imperative that the legal system confronts these challenges head-on. This study introduces the relevant legal system of U.S. law, which can be divided into: data privacy, biometric data privacy, and related to emerging technologies. Current regulations mainly focus on privacy, liability and labor right protection. The only viable solution to restore workers’ information autonomy is to enact specific legislation and provide comprehensive educational assistance. Relying solely on informed consent as a protection mechanism is insufficient. For reference, American law serves as a pertinent legal framework and policy guide. |
