寵物遭受不法侵害之慰撫金請求基礎

Abstract

本文旨在探討當寵物遭受不法侵害時，飼主遭受之精神痛苦是否可請求慰撫金？過往司法實務判決關於此一爭議乃肯否兩說互見，造成吾人對於是否可循法律規範主張自身權益無所適從。蓋此一法律見解歧異之主要原因，在於慰撫金之請求是否具有請求權基礎之看法不一，因此本文嘗試梳理關於寵物遭受不法侵害時，慰撫金請求通常所援引之民法第195條第1項及第3項關於人格法益及身分法益之相關規定，以及司法實務上解釋適用之保障範圍及發展趨勢，進而闡述在該條文規定下，寵物遭受不法侵害是否具有請求慰撫金之解釋空間。

This article is to discuss whether pet owners can claim consolation payment for mental distress when their pets are suffered from unlawful infringement. There are different court judgements on the dispute, resulted from distinct views on basis for consolation payment. People are confused and wondered whether they can claim consolation payment in this situation. Therefore, this article attempts to sort out the provisions of application, scope of protection, as well as trend of development on personal legal interests and family legal interests in Article 195, Item 1 and Item 3 of the Civil Law, which are sited for solatium claims, and then to explore the possibility for pet owners to claim consolation payment when their pets are suffered from unlawful infringement.
