Abstract: | 近些年來,為了進一步解決社會中層出不窮的性犯罪案件,一些國家已經陸續通過立法,把化學去勢合法化,作為對性侵害犯罪行為人之處遇措施,以期能夠藉此降低性侵害犯罪行為的發生或再次發生。儘管化學去勢面臨著許多爭議,但是這些爭議並沒有成為阻礙這些國家制定化學去勢法規之障礙。美國針對性犯罪行為人制定的法規與政策,可以說是嚴密且先進的。美國於1996年至2019年,已有近10個州陸續通過立法,把化學去勢作為一種新型的性犯罪再犯預防處遇。儘管這些州的化學去勢法規尚有不足之處,但作為他國化學去勢之立法模板,仍具有極大的參考價值。 In recent years, chemical castration has been increasingly adopted into the criminal treatment of sexual offenders in some countries in an attempt to prevent or reduce the occurrence or recurrence of sexual crimes in an effort that will further resolve the growth of sexual crimes in society. Despite the controversy surrounding chemical castration, these debates have not stymied the growth of chemical castration laws in these nations. In the United States, sex offender legislation and practices are strict and progressive. Nearly ten states in the United States approved legislation to make chemical castration a new way of sexual recidivism prevention between 1996 and 2019. Despite their flaws, these states' chemical castration laws are nonetheless extremely valuable as a model for chemical castration legislation in other nations. |
