我國公務人員年金改革制度及合憲性問題─以公務員退休資遣撫卹法2017年修改為中心

Abstract

蔡英文總統於2017年，推動修訂「公務人員退休資遣撫卹法」以作為公務人員年金制度改革的法律依據。年金改革雖然是國際潮流，但是我國推動年金改革卻是付出沉重的社會對立、世代衝突。為此，不禁讓人深思年金改革的道路，難道沒辦法凝聚全民的共識嗎？又臺灣在法治國原則的精神架構下，能否在合憲合法的框架內，推動一個符合人民期待的新年金制度。本文有感於此，遂以法治國原則為最上位精神，在信賴保護的基本精神與既有憲政體制下，希望能探討公務員年金制度改革之法制運作，並保障所有公務人員的基本權益。

In 2017, President Tsai Ing-wen promoted the revision of the “Retirement of Civil Service Retirement Pension Act” as the legal basis for the reform of the pension system for public servants. Although the annuity reform is an international trend, China's annuity reform is paying heavy social opposition and generational conflicts. For this reason, we cannot help but ponder the road of annuity reform. Can we not consolidate the consensus of the people? Under the spiritual framework of the principle of the rule of law, Taiwan can also promote a New Year gold system that meets the expectations of the people within the framework of the constitutional legality. This article feels that this is the reason. The principle of the rule of law is the highest spirit. Under the basic spirit of trust protection and the existing constitutional system, we hope to explore the legal system of the reform of the civil service annuity system and protect the basic rights and interests of all public servants.
