憲法對懲罰性賠償金倍數的立法限制—以現行法律規定為例

Abstract

本研究主要從我國憲法角度探討法律上設計懲罰性賠償金倍數制度 時應注意的憲法規定與憲法原則。本研究認為基於比例原則的要求， 憲法上懲罰性賠償金倍數數額容許空間為「個位數比例」。此外，基 於一行為不二罰原則，宜於立法增訂於個案懲罰性賠償金金額過鉅或 加害人有就同一行為已遭刑事處罰或行政處罰，民事法院應就懲罰性 賠償金的數額得予以酌減。

This thesis mainly discusses constraints, in the context of constitutional provisions and constitutional principles, on the draft bills of multiples of punitive damages from the perspective of the Constitution of Taiwan. Based on the requirements of the principle of proportionality, single-digit multipliers are constitutionally admissible for multiples of punitive damages. In addition, pursuant to the principle of double jeopardy, it is advisable to make laws to empower civil courts to reduce the requested amount of punitive damages when it is excessive or when the same perpetrators have been subject to criminal penalties or administrative penalties on the same illegal conduct.
