以民眾參與觀點檢視文化資產保存法上之審議程序：聚焦於聚落建築群

Abstract

本文研究目的，在於以民眾參與之角度，檢視文化資產保存法上關於聚落建築群保存法制之各程序，並兼就各程序階段之法制度問題，試圖在解釋論甚至立法論上提出看法。因而，本文首就民眾參與制度之基礎理論出發，並試圖就其於憲法上之依據與限制、制度設計上之指導原則歸納學說見解，以提供後續對聚落建築群法制為檢視之基本原則。 次就包含聚落建築群保存法制在內之文資法上文化資產審議模式為探討，並結合民眾參與制度中憲法上依據與限制所提供之理論基礎，以及民眾參與制度在學理上之制度功能等理論。試圖提出文化資產審議對民眾參與制度之需求性，以作為其引進民眾參與制度之理論基礎，並提供後續就聚落建築群法制各程序階段檢視民眾參與必要性之準則。 最後則就聚落建築群各程序階段之法制為具體檢視，並兼就其法制面上之各問題為探討，包含其與其他計畫法制之連結性。除前述民眾參與必要性之標準外，亦同時考量民眾參與制度制度設計上之各指導原則為標準。試圖就各階段程序法制，在解釋論以及立法論上提出適當之見解與建議。

The research purpose of this essay is to explore the procedures about groups of buildings in Cultural Heritage Preservation Act with the scope of citizen participation and make opinions to the legal problems in each procedures from the perspectives of the interpretation and even the legislative doctrine. Therefore, the essay develops from the basic theory of citizen participation at first and purposes the basic principles of examining the legal systems of groups of buildings by applying the guidance of the constitutional institutional designation to generalize legal interpretations. Then, this essay explores the cultural heritage preservation reviewing patterns which includes the legal mechanism of preserving groups of buildings, combines the constitutional theories about citizen participation with the theories about the institutional functions of citizen participation, and proposes the requirements of citizen participation to the review of the cultural heritage, with a view to developing a basis on introducing citizen participation mechanism to offer the legal systems of reviewing groups of buildings with the principle of the necessity of citizen participation. In the end, the essay deeply studies the legal systems in each procedural phases of reviewing groups of buildings and discusses on each legal issue including the connection with other planning institutions. In addition to the standards of citizen participation necessity as mentioned above, the thesis also takes each guiding principles of designation of citizen participation mechanism into consideration when setting up the standards. Furthermore, the essay tries to build up an appropriate opinion to every single procedural legal system in each phase through interpretation and from the legislative doctrine.
