兩岸建立共同打擊犯罪機制之研究－以兩岸刑事偵查合作為例

Abstract

本研究從歷史角度出發，觀察兩岸共同打擊犯罪發展之相互關係，再回顧兩岸刑事偵查合作歷史沿革及實際案例，加以歸納分析兩岸合作之經驗、模式及途徑，並希望藉由簽署「兩岸共同打擊犯罪」協議之際，提供建言俾利建構相關機制之模式及問題的瞭解，作一完整的探討剖析。 本研究分為六章：第一章緒論分別說明研究動機與目的、研究問題與研究假設、相關文獻回顧、研究範圍與研究限制、研究途徑與研究方法、研究架構與章節安排的說明。第二章就兩岸共同打擊犯罪的過程作一說明。第三章至第五章分別探討環境因素對兩岸共同打擊犯罪之影響，及由兩岸刑事偵查合作上之實務及案例進行探討分析，試圖建構機制之模式與途徑。第六章結論，以回應命題的方式，歸納本研究的發現並出建議。

From the point of history, this research observes the development of interactive relationship of joint cross- strait crime fighting. In retrospective, to generalize and analyze the past experiences, modes and paths of joint cross-strait criminal investigation, hoping through the establishment of joint cross-strait crime fighting mechanism, discussions of the effectiveness of its enforcement and a better understanding of the subsequent problems affiliated with the mechanism, this research can provide a complete analysis. This research is divided into six chapters: The first, introduction, separately discusses the motivation, research problems and research hypothesis, retrospection of related literary review, scope and limitation of the research, paths and methods of the research, structure of the research and discussion of the arrangement of chapters. The second chapter focuses on the process of joint cross-strait crime fighting. The third to the fifth chapter separately discusses the factors affecting the process of cross-strait crime fighting and analyzes the actual cases of joint cross-strait criminal investigative cooperation in an attempt to explore the modes and paths of criminal investigative mechanism. The sixth chapter, conclusion, in respond to the naming of the research title, will first generalize the findings of this chapter.
