摘要: | 文官制度涉及到國家公職務履行之合法性及正當性,因此,本論文探討國家進用公務人員之前以及進用後,如何審查使其具有最基礎之「適任性」,從公務人員任用法第28條「任用消極資格」之審查加以研究,分別有「國籍忠誠事由」、「法律責任事由」、「身心狀況事由」、「其他事由」,透過學理及實務相關爭議問題之探討,提出本研究心得及修正建議,俾使文官制度更符合時代之演進及人民之需求。 The system of civil servants is related to the legitimacy to of t the performaece of pubic mission,therefore,this article will forcus on the review of the civil servants’ competency when they into the government and after that .Researching on the Article 28 of “Civil Service Employment Act”,we can find four kinds of “unfitness factor”,include of :” factor of loyalty and nationality”, ” factor of legal responsibilityliability” , ” factor of psychosomatic illness”,and other else. Through this discussion of the issues in theories and practice , this article offer several opinions and suggestions, and look forward to the of the improvement of the system of civil servants. |
