論泰國身心障礙者權利公約施行之挑戰：以無障礙設施為中心

Abstract

人們對於包容性社會存在擔憂及疑慮，無障礙與通用性設計是保障每個人使用權利之重要關鍵，特別是環境建設對身障人士有最多的影響。因考量到身障人士之權利，聯合國通過身心障礙者權利公約，致力於促進、保護和保障身心障礙者，以及要求國家必須提出措施，致力消除對障礙之歧視。 然而，在泰國，身障者仍在日常生活中，面對諸多障礙與歧視，無效率的行政執行造成身障者難以平等，因此需反思執行策略。儘管公約中明確提及身障者之權利，但未能明確規定政府有效執行規範的義務，從而限縮了包容性的社會成效。考慮到身障者的權利重要性，他們的權利不應該被忽視。以此想法為出發點，本論文將深入研究現有的身心障礙者權利公約架構與有效執行，並探討如何強化社會對於身障人士之包容。

Concerns have been expressed regarding an inclusive society. Accessibility and universal design are the keys to promoting access for everyone. In particular, the persons with disabilities are those most affected by the built environment. Given the respect for the persons with disabilities, the Convention on the rights of persons with disabilities was passed to promote, protect and ensure their rights as well as to eliminate disability discrimination. However, there are still many of persons with disabilities in Thailand that face barriers and discriminations in daily life. Inaccessibility is a result of an ineffective implementation, which should become a serious concern. Despite the fact that the rights of persons with disabilities were mentioned in the Convention, failures to implement will minimize the effectiveness of rights provisions. Considering the importance of persons with disabilities, their rights should not be easily ignored. This thesis will look into the aspects of the CRPD and its implementation in Thailand, followed by the discussion on the possibilities to enhance social inclusion for persons with disabilities.
