Abstract: 本論文以政府選商程序之法律分析為題,並以介紹政府採購法與促進民間參與建設法之選商程序內容架構為重心,且嘗試釐清行政機關自選商程序之「開啟」迄至「終結」歷程中學理與實務上探究之法律爭議,並觀察得出現行兩部法律規範之選商程序有其各自立法目的之考量,也因此程序建置上之重心管制處應有差異,而行政機關發動選商程序過程中更應遵循其程序目的,以免選商之目的不達或耽擱行政目的之達成。又兩部選商程序毋寧在學理及實務上被認為係屬前階段行政處分,後階段屬於契約形式之雙階行為。然而,前階段選商程序規範關於程序進行中之內容,卻與後階段契約內容之形成相互分離,亦即,現行選商程序內容實欠缺對於個案「契約形成」之觀點。從而,本論文擬就學理上對於選商程序之相關法律行為、效力加以分析,並對於我國政府選商程序制度之運行利弊及可能之修正方向提出反思及修法建議。
This thesis tries to observe the evaluating process in Government Procurement Act and Act for Promotion of Private Participation in Infrastructure Projects. This thesis first introduces the basic models (the two-phase theory) of these two evaluating processes, and tries to figure out legal issues between these different acts. Second, this thesis not only explores the spirit of the laws, but also compares these two acts with procedures, measures and the court’s judgments related to.However, this thesis founded out, the contract formation in both evaluating process seems to be relatively infrequent. In conclusion, this thesis provides some suggestions to improve our evaluating processes.
