Abstract: | 我國市場操縱刑事法制之象徵性中介作用似乎有某種程度之發揮,而與美、英市場操縱刑事法制偏低的實踐度有所不同,而且我國市場操縱刑事法制具有主觀意圖要件紊亂、處罰極度前置與概括條款極度概括之特色。這樣粗糙而不具通盤思考的立法,正與前揭「階段性之妖魔化」與「祭旗浪潮」相互迎合,蓋在金融法律與刑事法律的耦合下,金融法律所要綁架的不是一部符合刑法基本原則、論述機制精細的市場操縱刑事法制,它所欲求的毋寧是一部放蕩不羈的入罪機器,透過金融專業話語在刑事判決中的恣意揮灑與包裝,忽視刑法基本原則,進而發揮象徵性刑法的象徵性中介作用,藉以掩飾當下行政規制的無力與民事保護機制的不足。 Symbolic intermediary role of the “Market Manipulation Criminal Legal System (MMCLS)” seems to have some degree of play in Taiwan, varying from the low practice of MMCLS in United States and Britain, with subjective intent requirements disorder, penalties extremely placed in front, and extremely broad general articles. The legislation of this kind, so rough without holistic thinking, panders to current 'staged demonization' and 'wave of sacrifice for the flag ', because of the coupling of the financial law and criminal law desires no kidnapping of a MMCLS in line with basic criminal law principles and elaborate discourse mechanism but rather a bohemian criminalization machine, through the willful swaying and make-up of the discourse of financial jargons, to neglect basic criminal law principles and further to play its symbolic intermediary role in order to cover the weakness of administrative regulation and the deficiency of civil protection. |
