| Abstract: | 這篇論文是探討人身保險適用複保險的議題，即使司法院大法官會議作成釋字第五七六號解釋，人身保險的詐領事件還是層出不窮。這號解釋解決了實際問題嗎？有三個方向得加以討論及考慮：1.法律議題（或社會現狀）的全貌，2.法學如何處理法律議題（法學方法論），3.經濟學如何處理法律議題（法律的經濟分析）；這般論述，期望消除弊害而提出補救。 This essay is to explore the issues of double insurance effective to personal insurance. Even the Judicial Yuan (Grand Justices Council, Interpretation No.576) made the interpretation, the personal insurance fraud still had been happening. This interpretation , did it solve practical problems? Three directions are to be discussed and considered, 1. the whole vision of the legal issues (or social status), 2. dealing with legal issues in law (legal methodology), 3. dealing with legal issues in economics (economic analysis of law); make such discourse, as shall suppress the mischief and advance the remedy. |
