摘要: | 咸認為韓非思想鞏固君主專制獨裁並操弄權術及嚴刑峻法,以遂君王之私利私欲,故歷來批判韓非之論不斷。惟本文重新檢視《韓非子》,察韓非思想之主張實係克私為公、撥亂反正、盡姦止惡、辨別真偽,以實踐公平正義之政治理念,故本文以《韓非子》中韓非之論為依據,以本文專論之中國思想人文研究法為研究途徑,排除通念上對韓非思想之界定,呈現出韓非政治思想之真正特質:以利害限制君王縱欲濫權、以自然之道虛位君權、以罪刑法定原則規範君王賞罰分明、以仁義為本質之嚴刑峻法、以辨別真偽與盡姦止惡為本質之權術,且韓非批判之「儒」與孔子、孟子、荀子、莊子所批判之「儒」並無二致,實與學界認為韓非思想係推動暴君暴政之通念迥異。本文最後亦以韓非政治思想檢視當代民主政治理論,以探討二千多年前之韓非思想之當代價值,包括人權。 Previous studies argue that the thoughts of Han Fei legitimized the autocracy and dictatorship of the monarchy, and manipulated politics and severe laws for the kings’ personal benefits and desire, thus, Han Fei has been constantly criticized. However, this study reviews Han Feizi, and realizes that thoughts of Han Fei referred to “restraining the individual to protect the public”, “bringing order and justice out of unrest”, the avoidance of evilness, and the discernment of genuine and fake, in order to carry out the political ideal of fairness and justice. Hence, based on the arguments of Han Fei in Han Feizi, and through the humanistic research method of Chinese thoughts as the research approach, this monograph casts aside the previous definitions of the criticism of Han Fei, and presents the authentic characteristics of the political thoughts of Han Fei, namely restricting the kings’ abuse of desire and privilege by subsistence and extinction, limiting the monarchical power by the principle of 'Tao' of nature, regulating the kings’ rewards and punishments by laws, enforcing severe laws but with the nature of benevolence and righteousness, exercising the arts of politics to distinguish the genuine and fake and to avoid evilness. Moreover, “Confucian” was criticized by Han Fei, which is consistent with that of Confucius, Mencius, Xun Kuang, and Zhuang Zhou. These results are different from the general academic view, which state that the thoughts of Han Fei reinforced tyrants and tyranny. Finally, this study reviews the contemporary democratic theories according to the political thoughts of Han Fei from more than 2000 years ago, in order to explore modern values, including human rights. |
