| Abstract: | 「身分行為」原則上不許代理。「醫療同意」行為，具有比身分行為更高的切身性，因此的「不許代理」的性格也更為強烈。而不許代理原則的開展，將導致「能力年齡的下降」與「多方行為的形成」。本文參考國內外學說、判決與實證研究，並以「子女過養」行為，來比附醫療同意行為中，不許代理原則的影響。經由以上概念的討論，建構出醫療同意行為，「能力與代理」的圖像，並提出對我國醫療法第63, 64條的修法建議。 |
