以客觀歸責論被害人介入之因果關係中斷

Abstract

因果關係之判斷一直是個充滿爭議性的議題，學說理論甚多卻一直未有定論，當案件牽涉被害人介入時，判斷更顯複雜困難。本文認為單就因果關係不足以證立行為人責任之成立，責任之歸屬乃歸責之問題，此為獨立於因果關係外的議題，因此，因果關係中斷確切的說為歸責阻斷。本文嘗試以客觀歸責理論協助判斷損害賠償責任歸屬，並且於被害人介入之案件中之適用作階層順序及原則詮釋的調整，以期能提供一個更為穩定充分的理由來說明何以得使“損害例外不停留於原地”，而讓行為人負責。

Causation has always been a controversial topic ever since the needs of human race dispute settlement arised. There are tons of deferent theories trying to solve this mystery and yet no firm conclusion. The problem gets even more complicated when the case involved contribution from victims. I’m trying to approach this issue by applying objective imputation theory. With the effort of priority adjustment and deferent interpretation of principles, hoping to provide a more stable and detailed answer to this question.
