| Abstract: | 本論文對於以財產上預期利益為目的之身體法益處分探論，所側重者，實係此種身體法益處分之負面效力要件，亦即，於何種要件下，此種身體法益處分係歸於無效。身體法益處分之效力，直接影響其所涉身體法益侵害行為之違法性：若係有效，其所涉身體法益侵害行為即得阻卻違法；反之，則不得阻卻違法，身體法益持有者所持有之身體法益遂得以獲得保護。職此，本論文對於以財產上預期利益為目的之身體法益處分，即以論述其處分之負面效力要件為軸心。 |
