我國犯罪組織抗制政策之研究 -以太陽會之取締為例

Abstract

論文提要內容：台灣的犯罪組織，從歷史的發展看，顯然直接涉及台灣的黑道幫派組織及其發展；而從其組織型態和犯罪內容看，正是反映台灣從威權時期、威權轉型到民主鞏固時期，其政治、經濟與社會特質的發展過程。 過去五十多年來，政府面對台灣地區犯罪組織的發展與作為，雖也有各種不同的抗制政策，無論是國民黨執政時期，抑或二○○○年政黨輪替之後，都曾多次執行掃黑行動。 本文希望從內外政經變遷的過程，重新釐清黑幫組織及犯罪組織的發展，並分析政府相應的抗制政策，且以基隆市警局取締「太陽會」案作例證，檢討當前犯罪組織抗制政策的得失。

It is obvious that the organized crime is directly related to the development of gangs in Taiwan. The types of organized crime reflect the political and economic changes and the development of authorities and democracy in Taiwan. There were a lot of programs and controlling policies enforced by officials in fighting with the organized crime in Taiwan both in KMT and DPP governments. In this paper, the development of organized crime is introduced from the perspective of political and economic changes. The criminal justice polices regarding the organized crime are also discussed. And the Sun Club, an organized criminal association in Keelung, was introduced as an example to study the Keelung Police Station’s policies on organized crime.
