困境企業資本結構重建及其相關法律問題：以光伏產業為例

Abstract

摘 要 經濟，政治，文化，這三樣事物是整個人類社會的組成部分。他們三者不斷地影響著對方，促進著人類社會的發展。經濟是人類社會的物質基礎。與政治是人類社會的上層建築一樣，是構建人類社會並維繫人類社會運行的必要條件。其具體含義隨語言環境的不同而不同，大到一國的國民經濟，小到一家的收入支出，有時候用來表示財政狀態，有時候又會用來表示生產狀態。同樣，企業的運作和發展也和社會上經濟的狀態有著密不可分的關係，正是因為社會是不停地發展，各種條件都可能影響到企業的運作。就像是“花無百日紅”，企業也不可能一直處於鼎盛的狀態，任何企業都可能由於一點小失誤而陷入困境當中。而這些困境企業在別人眼裏似乎是跗骨之蛆，不願意與其扯上任何的關係。但是困境企業也有著自己的價值和希望，如何化腐朽為神奇，並從中獲利，是一個新興的研究方向。

Abstract Economic, politics and culture are the main part of the whole world community. The three of them keeps influencing each other all the time and promote the development of human society. Economy is the material foundation of human society while politics is seen as a superstructure,.They construct the human society and maintain the necessary environment for society’s operation. Its specific meaning varies with the language environment, they may refer to a country's national economy, or a family’s income and expenditure, sometimes are used to indicate the financial state and production. The operation and development of enterprises and the state of society's economy has a close relationship, precisely because the society is constantly developing under various conditions which may affect the operation of enterprises. Like a saying goes 'No flower can bloom for a hundred days', companies can not have been in the heyday of the state, any enterprise may get into trouble due to a little mistake. These dilemma enterprises are like a Maggots tarsal in the eyes of others people who do not want to have anything to do with the it. But the dilemma enterprises also have their own values and hopes, how to turn it into miracle, to get profit, is my research’s direction.
