智財案件審理之專業化與效率之探討

Abstract

智慧財產新制設置專利審查官，解決技術審查官的名稱、能力和公正問題，有助於法院專業審理之促進。舉發案行政救濟程序冗長，專利舉發案行政救濟程序長遠之道，可參考和採納德國法當事人對立訴訟制度，避免走入行政爭訟程序，以增進效率，目前則宜簡化縮短救濟程序。侵權訴訟中智慧財產法院雖得就專利有效性自為判斷，然而其判決效力僅及於當事人之間。考量到避免裁判歧異、二次訴訟再為爭執以及智慧財產法院審理之專業，智慧財產法院對於專利有效性之判斷，應具有對世效，得拘束行政機關和行政法院，以發揮其專業審理和效率促進之功能。

The new system of intellectual property set the Technical Examination Officer. To resolve the title, ability and unfairness problem can enhance the professionalism. The process of invalidation is so complicated, we can adopt Germany law system to prevent from entering complicated administrative remedy in the future. Now we should make the process of invalidation simple. In infringement litigation, the Intellectual Property Court (IP Court)can decide the patent validity, but the effect of the judgment is limited. Preventing from decision discrepancy, re-litigation and considering the professionalism of IP Court, the effect of the judgment should be extended to enhance the professionalism and efficiency.
