藝術授權機制與數位影像在著作權法上的地位之研究

Abstract

以往藝術作品的授權大多集中在平面作品的授權上。然而，過去幾年來，透過藝術授權生產的衍生商品不斷地擴大，藝術授權的作品類型變得更加廣泛。藝術授權機制亦因授權範圍及方式的擴大，使得其面臨的法律問題卻也更加複雜。 另一方面，為了因應趨勢，博物館或美術館多以數位攝影方式將典藏品變成數位影像，不但可建立其典藏品管理系統，同時亦將這些數位影像放置於網路上，供公眾瀏覽。然而，這些數位影像的法律性質究竟為何，是否受著作權法保護，爭議不斷。有認為應受著作權法保護，有認為不受著作權法保護，這個問題在典藏品的數位影像遭人盜用侵害時，得否主張權利的正當性，更顯重要。 本研究分成兩個主軸來討論。第一個主軸是針對藝術授權機制進行討論。首先，探討國外已經建立的藝術授權機制，瞭解不同的授權模式及其優缺點，並分析大都會博物館的授權模式供我國參考。其次，以外國的藝術授權機制為基礎來探討我國法制下可能的藝術授權機制，並分析不同授權模式下的法律關係，同時評析故宮博物院的授權模式。 第二個主軸則是針對數位影像在著作權法上的地位進行討論。現今藝術授權機制與數位影像密不可分，然而，由於數位影像所具的機械性本質，使得數位影像在著作權法的地位不明。本研究透過國內外學說及實務見解來探討相關的議題，並總結歸納出數位影像在著作權法上的地位。

This study is about 'art licensing' and 'copyright issues of digital image'. This study begins with a discussion of the art licensing mechanism. First of all, this study introduces the art licensing mechanism of foreign countries and then it discusses four alternative models for museums to license their images. Secondly, this study analyzes the foreign-based art licensing mechanism under the law of Taiwan. The Second part of this study is about 'copyright issues of digital image'. Licensing digital images becomes mainstream through the technology of digitalization. Such digital images are obtained by digital photographing the original art works. However, there are many legal issues of such kind of digital images because of their mechanical nature. This study canvass related issues by analyzing law theory and practice. At the end of this study, it concludes the legal status of digital image in copyright law.
