| dc.description.abstract | 對知識產權的日益重視以及盜版產品普遍存在的問題，突顯了有效法律框架和懲罰措施的重要性。本研究探討懲罰性賠償金對於市場及出版商的影響，並通過實證研究進行驗證。研究首先建立效用函數以理解消費者行為，接著提出了斯塔克爾伯格博弈模型，將出版商作為領導者，將合法和盜版平台運營商作為追隨者，以確定各個參與者的最佳解。然後，研究在不同條件下分析侵權行為，並探討懲罰性賠償金的倍數如何影響出版商的收入、正版產品需求及電影票價。實證研究驗證了分析結果，即工作室的收入、正版產品需求及電影票價呈現出遞增函數並且邊際效益遞減。 | zh_TW |
| dc.description.abstract | The growing emphasis on intellectual property rights and the widespread issue of pirated products highlight the increasing significance of effective legal frameworks and penalties. This study explores the impact of punitive damages on the market and publishers, validated through empirical study. The research begins by establishing a utility function to understand consumer behaviors. This study presents the Stackelberg game model, positioning publishers as leaders and legal and pirated platform operators as followers to determine the optimal solutions for each participant. The study then analytically investigates infringement behaviors under different conditions and examines how the severity of punitive damages affects publisher revenue, demand and ticket price. An empirical study validates the analytical results that the revenue of the studio behave, the demand for legitimate products, and movie ticket prices exhibit an increasing function with diminishing marginal returns. | en |
