司法毒品處遇制度再建構

Abstract

毒品問題歷來是我國刑事政策上重要的問題，其中，如何運用處遇制度減少成癮與施用毒品罪的再犯更是毒品議題中的重要關鍵。本文的主要目的即在於嘗試提出一種新的處遇制度架構，而相較於該處遇制度是否具有良好的戒除毒癮的成效，本文更具焦於處遇制度是否能夠關照於個人內在的需求，以及能否有效的與個人的內在互動。 為了能夠建構出關照內在的處遇制度，本文通過文獻與理論的呈現，一方面描繪現行制度的樣貌，一方面則運用差異正義、個人中心主義和少年事件處理法作為理論基礎，逐步說明若一個處遇制度要能夠提供受處遇者信賴、關注與接納，制度本身在對成癮觀點的典範所需要的轉移，以及制度實踐過程中所應抱持的精神與形式外觀的指引。在呈現出新處遇制度的樣貌後，本文嘗試解釋此制度窒礙難行的原因，並指出克服這些困難的背後所需要的是立法者的政治決斷。

The drug problem has always been an important issue in our country's criminal policy. Among them, how to use the treatment system to reduce addiction and recidivism in drug use crimes is a crucial aspect of the drug issue. The main purpose of this article is to propose a new treatment system framework. Instead of focusing solely on the effectiveness of the treatment system in overcoming drug addiction, this article emphasizes whether the treatment system can cater to individuals' intrinsic needs and effectively interact with their inner selves. In order to construct a treatment system that caters to the inner self, this article presents relevant literature and theories. On one hand, it depicts the current state of the existing system, and on the other hand, it applies theories of differential justice, person-centeredness, and the juvenile justice law as theoretical foundations. It gradually explains that for a treatment system to provide trust, care, and acceptance to the individuals undergoing treatment, the system itself needs a paradigm shift in its perspective on addiction, as well as guidance regarding the spirit and outward form during the implementation process. After presenting the appearance of the new treatment system, this article attempts to explain the reasons behind the challenges in implementing this system and points out that overcoming these difficulties requires political determination on the part of lawmakers.
