dc.description.abstract"非法、未報告與未受管制捕魚(Illegal, Unreported and Unregulated Fishing,以下簡稱IUU捕魚)議題乃當前國際漁業管理的重中之重。IUU捕魚對海洋生物資源的永續性、糧食安全與經濟活動秩序構成威脅。鑑於國際間早已對船旗國專屬管轄的侷限性有所認識,港口國的重要性開始受到重視。在全球層次,以聯合國糧農組織(Food and Agriculture Organization,FAO)為核心,建立起多項有拘束力或非拘束力的國際文件,一步一步充實與具體化港口國措施之內涵。2009年通過的《港口國措施協定》使港口國的角色獲得較為明確的界定。在區域層次則是以RFMO為核心,引導與協助國家落實PSMA,但RFMO本身亦存在著與PSMA之間的落差需要填補。然而,並非是國家進行PSMA的締約後就等於措施能被確實履行,若要對港口國措施的實際運作情況有更深刻的認識,並提出務實的建議,國家層次的分析是不能被忽略的。 在國家層次的分析方面,筆者分別以四個面向來檢視:第一,從批准與內國法化方式看國家對國際社會作出何種承諾(commitment);第二,從全球行政法的角度,打破國家界線,對國家行政主體受到監督情況進行分析,並對問責機制的建立提出反思;第三,筆者分析了案例國在具體的港口國措施上所應用政策工具(policy instruments),並就應用情形提出檢討與建議;第四,檢視案例作為港口國的事後責任工具(liability instruments)使用情況,並點出在這方面可能存在的課題。 整體而言,可以看出美國深化國際規範的條件明顯優於日本與臺灣。美國以門檻較高的條約形式批准PSMA,展現出其履行協定之決心。在國內監督方面,國會的角色相當積極,這也有利於行政部門在日常運作上就具備較高的資訊透明性。同時美國作為國際漁業秩序領導者,本身並沒有受到外部監督。而美國在實際的港口國措施運作上,展現出充沛的檢查與執法能量。又其具體措施安排與PSMA幾乎一致,故認為其具備較良好的深化國際規範條件。日本則是僅以內閣權限,以門檻非常低且彈性較高的行政命令手段使PSMA在國內產生效力。日本加入PSMA可能是為了回應國內壓力,對於國際社會並不需要特意展現其承諾。來自國會的監督力量是否足以發揮有效監督,難以得知。日本的港口國措施相當嚴格,運用嚴格的規則工具對外國漁船施加相當沈重的遵守成本。對日本而言,港口國措施的實施除了打擊IUU捕魚之外,可能還有包含抑制外國人漁業活動之目的。臺灣很明顯是出於歐盟黃牌的壓力才出現的漁業法規的改革,並致力於展現改善遠洋漁業管理的承諾。然而,國內對於行政機關日常運作的監督力道並不強烈,且過於仰賴國家外部的監督。就臺灣政策工具應用的情況來說,雖然符合PSMA的基本要求,但在入港後的查核項目方面仍稍嫌不足,這可能是政府在內外壓力之下考量執法成本後所作出的平衡。 本研究所探討的三個案例所遇到的共同課題在於過於仰賴規則工具,缺乏對其他類型政策工具之考量。而在港口國責任工具的應用方面,由於PSMA規範的空白,港口國之間對在港內從事違法行為的外國漁船的責任工具運用產生較多歧異,而這可能是不利於國際規範獲得協調的。"zh_TW
