論保險詐欺之預防

Abstract

近年來隨著人民保險率的增高，人民對保險制度的依存度也日漸增加。而卻常在傳播媒體發現常有民眾利用保險詐欺來不當得利。 保險詐欺會破壞保險制度的穩定及使保險公司賠錢受害，更重要的事破壞保險制度，使的保險理賠率升高、保險費提高，受害者則是全體投保的民眾。目前我國致力於保險詐欺的防制，尤其成立了財團法人保險犯罪防治中心，其與交通部公路總局合作失竊車輛通報系統後，產險理賠大為降低。 本文會先檢視各國防制保險詐欺之現況、立法規定，從而檢討我國防制保險詐欺之現況、立法規定之有效性與缺失，並希冀能分析出降低保險詐欺行為發生之建議。

In recent years, with the increase of people's insurance rate, people's dependence on the insurance system is also increasing. However, it is often found in the media that people often use insurance fraud to make unjust gains. Insurance fraud will destroy the stability of the insurance system and make the insurance company lose money. More importantly, it will destroy the insurance system, increase the insurance claim rate and premium. The victims are all the people who insure. At present, China is committed to the prevention of insurance fraud, especially the establishment of a consortium legal person insurance crime prevention and control center. After cooperating with the General Administration of Highway of the Ministry of Communications and theft vehicle notification system, property insurance claims have been greatly reduced. This paper first reviews the current situation and legislative provisions of various countries to prevent insurance fraud, so as to review the current situation of China's prevention of insurance fraud, the effectiveness and deficiencies of legislative provisions, and hope to analyze the suggestions to reduce the occurrence of insurance fraud.
