現行環保處理法規對企業經營之影響 —以個案公司為例

Abstract

在環保意識抬頭，環保法規日趨嚴格，科技日新月異高速發展，執法越趨落實下，企業在法令遵循上越來越上軌道。 政府各主管機關制定多項法令來管理事業廢棄物，避免事業廢棄物的處理不當以致汙染環境，進而製造更多的環保災害。在這些法規內，除控管產出廢棄物的廠商外，也規範了配合清運及處理的專業處理機構，目的是讓合格的專業處理機構有能力處理各廠商產出的廢棄物，以消化及減少這些廢棄物對環境的衝擊。 在缺水、缺電、缺工、缺地、缺人才及缺乏處理工業廢棄物的能量的當下，各企業都面臨環保法規限制下的困境，個案公司從自身核心優勢出發尋求解決之道，以因應廢棄物處理產能缺乏的困境。主管機關可從政策制度面或作業方式上做一些改變，開放環保產業嚴格特許的市場運作方式，以開放態度或積極輔導民間機構從事環保產業，從而增加處理廢棄物的產能；或同整需求面的資訊，或提供技術輔導或顧問補助，從供給及需求二方面著手，才能解決這場即將到來的環保與經濟二難的風暴。

With the rising awareness of environmental protection, stricter environmental laws and regulations, rapid development of science and technology, and more implementation of law enforcement, companies are getting more and more on track in compliance with laws and regulations. The competent authorities of the government have formulated a number of laws and regulations to manage industrial wastes to avoid improper disposal of industrial wastes that would pollute the environment and create more environmental disasters. In these regulations, in addition to controlling the manufacturers of waste produced, professional treatment institutions cooperating with the removal and treatment are also regulated. The purpose is to enable qualified professional treatment institutions to be able to process the waste produced by various manufacturers and to digest and reduce the impact of these wastes on the environment. In the current situation of lack of water, electricity, labor, land, talents, and energy to dispose of industrial waste, all enterprises are facing difficulties under the restrictions of environmental protection laws and regulations. The individual company seeks solutions based on their core strengths, in response to the dilemma of lack of waste treatment capacity. The competent authority can make some changes in the policy system or operating methods, open up the strictly licensed market operation mode of the environmental protection industry, adopt an open attitude or actively guide private organizations to engage in the environmental protection industry, so as to increase the production capacity of waste disposal. We can start from integrating with the two aspects of supply and demand, or providing technical guidance or consultant subsidies, or converging demand side companies, to solve the coming storm of environmental protection and economic dilemma.
