摘要: | 進入21世紀之後,著作權法成為了變動幅度最大、最為嚴格的法律,不僅是重製行為的嚴罰化,其中針對數位的權利保護資訊的法規保護在全世界變成炙手可熱的主題。目前世界的趨勢(我國目前也是)將對於前端保護措施破解的行為犯罪化,將其視為侵害著作財產權的行爲。但如果從著作財產權侵害犯罪的階段來看,該行為僅為破壞前端保護措施的行為,屬於重製犯罪的前行為,且該前行為並不必然引起重製權的侵害。雖是如此,著作權法將許多可能為侵害著作權的前行為犯罪化。面對著作權法中逐漸提高的法定刑,以及法規的層升結構,如果在保護法益論上沒有找到相應的不法內涵,此種透過不斷提升的方式提高法定刑或是不斷的前置犯罪的方法來嚇阻避免觸犯著作權法,有欠缺正當性之疑慮。從加重常業犯的立法理由以及光碟使用入法的立法理由來看,此毋寧是尋求嚇阻的方式來達到殺雞儆猴的效果。但就算我國立法委員採取現象立法的方式,仍有可能在解釋論上找到合理的依據,本文以下將從歷史的觀念試圖理出現行法的頭緒,並且此嘗試為限縮解釋。 第二章引進對於認知語言學的詮釋,透過認知語言學的理論說明著作權法在歷史上出現的偶然,又如何從人類的認知結構中說明為何這偶然變成了必然。第三章則透過現行著作權法中所存在的多元理解說明為何著作不只是等於財產,在法規的設計上其實著作權法是充滿多種多樣的理解。並且進一步介紹形式歸在在比較法上(美國、日本)也是多種多樣的理解,並非將著作等於財產權作為一可能的答案。第四章,簡要說明法益理論的變化裡使,並且引用日本學者嘉門優的見解認為法益論仍有存在必要,對於犯罪的侵害內涵的認定以及法定刑的決定上具有重要的任務。就此進一步分析著作財產權的犯罪保護法益,透過歷史以及現行法的觀點說明一個更好的詮釋方法「競爭秩序與個人財產法益」。就此重新詮釋著作權法第91條以及第92條的構成要件。最後第五章說明關於本論文的後設理論。提出小小的建議,期待我們進入一個新世界。 After entering the 21st century, copyright law has become the most changeable and strict law, not only the re-regulation of behavior, in which the protection of digital rights information laws and regulations have become a hot topic around the world. In the face of the increasing legal punishment in copyright law, as well as the hierarchical structure of laws and regulations. If we do not find the corresponding meaning of law in the theory of protection law, there is a lack of legitimacy in such ways as to raise statutory punishment or to prevent the prevention of copyright law violations by means of continuous improvement. Judging from the legislative reasons for aggravating the regular offenders and the legislative reasons for the use of CD-ROMs into the law, it is better to seek a deterrent way to achieve the effect of killing chicken macaques. However, even if our country's legislators take the way of phenomenon legislation, it is still possible to find a reasonable basis in explanatory theory, the following article will try to reason from the concept of history, and this attempt to limit the interpretation. The second chapter introduces the interpretation of cognitive linguistics, through the theory of cognitive linguistics to explain the history of copyright law, and how to explain from the cognitive structure of mankind why this accident became inevitable. The third chapter explains why works are not only equal to property, but also in the design of laws and regulations. And the form of further introduction to the comparative law (the United States, Japan) is also a variety of understanding, not the work equal to property rights as a possible answer. The fourth chapter briefly explains the changes in the theory of legal benefits, and cites the opinion of the Japanese scholar Jiamenyou that the theory of legal benefits is still necessary, which has an important task in determining the connotation of crime and the decision of statutory punishment. In this regard, further analysis of the criminal protection of property rights of works, through the historical and existing law point of view to explain a better interpretation of the competitive order and personal property law benefits. In this regard, the elements of article 91 and article 92 of the Copyright Act are reinterpreted. Finally, the fifth chapter explains the theory of the post-establishment of this thesis. Make small suggestions and expect us to enter a new world. |
