摘要: 有鑒於近年來國際間之專利指控事件層出不窮,台灣亦逐漸察覺到專利之重要性。然而,台灣在看似優良的專利數據下,企業須支付之海外智財權利金仍處於高水位。其中很關鍵的原因為台灣專利品質普遍不佳以及專利佈局不足,導致無法達到自我保護,亦無法將無形智財資產及發明技術擴散以轉化成為現金流。而若要做好完善的專利佈局,首先要有數個良好的專利構想,即一構想之各種變換組合以及延伸應用,以利後續之專利佈局,使發明人於未來得以主張專利。此外,台灣專利之可專利性也有待提升。現今發明人時常遇到的困境為,目前市面上之創新方法種類雖繁多,其所得結果卻未必能夠通過專利申請,而著名的系統化創新方法TRIZ理論有多數發明人反應其概念過於複雜不易使用。因此,本研究希望提供一建構專利構想之方法,以幫助發明人發想出具有更多變換組合與延伸應用以及具有較高可專利性之專利構想,且此方法直觀易懂,使發明人可快速掌握並使用。最後,本研究再提供一個實際案例以驗證所提供之方法的可行性,其確實有利於幫助發明人獲得具有更多變換組合與延伸應用且具有較高可專利性之專利構想。
Due to the fact that the international lawsuit regarding patent infringement appears very often, the corporation owners, which, of course, include those in Taiwan, have gradually realized the importance of patent. However, with the rather high amount of patents owned, Taiwanese corporations still pay above-the-average patent premium. The key reason is because of the bad quality and the insufficient deployment of Taiwan's patents, which cannot transform the virtual intellectual property and expand the patent into real cash. In order to make a perfect patent deployment, it starts with a number of good patent ideas, namely the various transformation combinations and extension applications of an idea, to facilitate the subsequent patent deployment so that inventors can claim the patents in the future. Moreover, the patentability of Taiwan's patents has yet to be improved. Nowadays, inventors often encounter the dilemma that the results of current innovation methods are not necessarily patentable, while the famous systematic innovation method TRIZ Theory has been responded that the concept is too complex and difficult to be used by the majority of inventors. Therefore, this research aims at building a better process for patent ideas construction to help inventors develop the patent ideas with more transformation combinations and extension applications and higher patentability, and this method is intuitive and easy to understand so that inventors can quickly know the ropes and use it. At last, a real case is provided to prove the feasibility of this theory of patent ideas construction, which will prove that this theory will really be beneficial to help inventors to obtain the patent ideas with more transformation combinations and extension applications and higher patentability.
