dc.description.abstract | 本論文主要研究於泰國和台灣的重要政治職位者犯貪污罪之刑事訴訟程序。此外,本文亦比較研究特定泰國重要政治職位者犯貪污罪之刑事訴訟的優點和缺點。
這篇論文的研究方法是基於根據閱讀課本,文章和期刊關於泰國與台灣的重要政治職位者刑事訴訟程序為分析思考的目的。並且端詳修正反腐敗組織法(第二卷) 與重要政治職位者犯貪污罪之刑事訴訟組織法為主。 這拼論文目的,在關於重要政治職位者犯貪污罪之刑事訴訟程序,於兩個司法管轄區之間差異性和相似性。在台灣,最高法院檢察署特別偵查組(SID)負責此種貪瀆案件。而泰國成立的國家反腐敗委員會(NACC),是一個獨立的機構。為了對應NACC的建立,泰國於1999年9月最高法院成立重要政治職位者之刑事審判庭。泰國的前總理塔克辛(Thaksin Shinawatra)與台灣的前總統陳水扁是著名貪污案件,屬於這些機構的職責。況且,目前國際刑事訴訟制度適用混合於對抗制度跟調查制度系統。台灣於2002年從調查制度改成對抗制度,泰國卻為處理重要政治職位者犯貪污罪之刑事案件換對抗制度成為調查制度。然而,應該改善完整的調查制度的缺點,然後使用抗辯式訴訟制度的優勢提升被告人的地位當過程主體,並更多尊重具有重政治職位的被告人權。 | zh_TW |
dc.description.abstract | This thesis focuses on criminal proceedings against persons holding political positions regarding corruption in Thailand and Taiwan. Furthermore, this thesis compares advantages and disadvantages of Thailand’s criminal proceedings against persons holding political position which is unique from general criminal proceedings.
The methodology for this thesis is mainly based on reading textbooks, articles, and journals in regard to criminal proceedings against persons holding political position in Thailand and Taiwan in case of corruption for the purpose of analytical thinking. Additionally, observing the Revised Organic Act on Counter Corruption (Vol.2) B.E.2554 (2011) and the Organic Act on Criminal Procedure for Persons Holding Political Position B.E. 2542 (1999) is highly important. The significant objective of this thesis is what difference and similarity between Thailand and Taiwan, both of jurisdictions, about criminal proceedings against persons holding political positions who commit the corruption offence, and related agencies. In Taiwan, the Special Investigation Division of the Supreme Prosecutors Office (SID) in charge of this kind of criminal case, while Thailand established the National Anti-Corruption Commission (NACC) to be an independent agency. In order to correspond with the establishment of the NACC, the Supreme Court’s Criminal Division for Persons Holding Political Positions was set up in September 1999. Thaksin Shinawatra’s and Chen Shui-bian’s are notable cases related to corruption against the leader politicians which these organizations are responsible. Moreover, international system of criminal procedure nowadays applies a mixed system of adversarial system and inquisitorial system. Taiwan changed its trial procedure from an inquisitorial system to adversarial system in 2002, whereas Thailand switched its adversarial to inquisitorial procedure for corruption cases of persons holding political positions. Yet, the disadvantages of full inquisitorial system should be improved, use the advantage of adversarial system to raise the status of defendant to be Process-subject and more respect the human rights of defendant who holds political position. | en |
