公共建築統包方式發包設計項目架構之研究

Abstract

對於主辦機關而言，統包標招方式在尚未設計完成即辦理招標具有高度風險，在以往許多統包工程案例中，將太多的注意力集中在工程預算與時程的執行成果上，而反倒忽略了工程範圍明確界定的重要性，以致陸續衍生出許多糾紛與爭議。當業主確定以統包方式辦理招標時，除法令另有規定者外，至少應依「統包實施辦法」第6條之規定，將應載明事項公告於招標文件中，業主如果明確掌握統包工程發展預期的需求目的，反應主辦機關內部需求營運策略，在避免過高的需求或限制統包商的設計彈性及引進新工法之空間原則下，給予統包商做為發展規劃、設計參考之設計規範愈為明確，則造就工程標案順利完成的機率也就愈高。 以往探討統包需求條件的文獻並不多見，且大多徧重於設計管理問題。本研究主要以協助業主的立場，探討在選擇統包發包方式之公有建築工程其設計工作範圍應有的項目，藉由案例、專家訪談及問卷調查對於主辦機關設計工作範圍擬定意見之統整，並進一步統計分析，以尋求建立需求計畫中涉及設計部分之重要關鍵要項，最後歸納適當之統包建築工程的設計項目。希望藉此成果，能夠提供國內各公共工程相關單位對於建築工程設計需求計畫擬定參考，以期對主辦機關興建計畫落實能有所貢獻。

The responsible entity became aware of the high risk in turnkey bid execution derived from the turnkey bidding of which the basic design has not been completed yet. By reviewing of those past turkey bidding cases, there were excess focuses on the execution of engineering costing and scheduling and the significance of concrete construction scope was ignored. Consequently, various arguments and disputes resulted from this weakness. Once the proprietor decides to undertake turnkey tender, except those of regulation obligation, the written requirement of the tender document must be promulgated in compliance with article 6 of Regulations for the implementation of turnkey. Provided that the proprietor could firmly identify its objective of construction work and demonstrate inner operation strategy of responsible entity, while following the principle of avoiding too much limitation on turnkey contractor’s design flexibility and new technique employment; turnkey contractor obtains more positive standards of planning and design references and higher success possibility of construction bid execution would be managed. Few literatures examining prerequisite of turnkey were found in the past, most subjects dealt with management for design phase. With assist proprietor’s point of view this research has been deliberated on designing scope necessary for public construction work whereas selecting turnkey tender procedure. By means of case study, expert interview and questionnaire survey, those initial drafting suggestions of responsible entity have been compiled together; after perform statistical analysis in depth essential requirements related to design task of project have been established and finalize one applicable designing items of turnkey construction. The paper is aiming to serve as reference for drafting engineering design project of public construction entities as well as fulfill making responsible entity’s construction project practicable.
