台灣地區法律服務產業經營管理要素探討--依不同規模事務所為區分

Abstract

目前台灣法律事務所的經營面臨多方之變化，首先由於政經情勢變化，使得國內法律環境漸趨複雜化；其次，近年來律師錄取人數快速增加，使得產業環境由量變而質變；另外，大型事務所之雛形已漸趨成熟，不同規模事務所於經營管理上所遭遇之問題亦有所區隔。本研究之目的希望針對不同規模事務所探討其經營管理上異同之處，並就實務上操作作出建議。 本文主要以質化研究之方法，針對不同規模之法律事務所進行深度訪談，並與類似專業性質之專利商標事務所及民間公證人事務所之訪談結論作一比較。本研究所得之主要結論如下： 1.事務所經營規模不同決定經營思維，關鍵在於業務類型截然不同。 2.中型事務所在市場上的重要性將與日俱增，惟良好的晉升制度至為關鍵。 3.都會區小型事務所於競爭態勢最弱應伺機向中型事務所發展，否則價格競爭勢無法避免。 4.專利商標事務所與民間公證人與一般法律事務所經營模式不同，因非屬高度客製化之服務類型。

Recently, the operation of law firms in Taiwan faces various changes. First of all, with the political and economic circumstance change, the legal surroundings has become complex. Second, the population of passing the bar exam rapidly increases, which causes the industry to change both in quantity and quality. In addition, huge-size law firms have emerged to the market and law firms in various scales would like to handle the issues for the management in different ways. This study aims to explore the aspects of management for law firms in terms of scales and provide suggestions for the practice. This study adopts qualitative methodology to include interviews with law firms of different scale. Besides, this study also compares the above mentioned result with that derived from interviews with patent firm and the private notary. The conclusion of this study is as follows, a. The scale of law firm would be a crucial factor for management decision making, as the business type thereof is totally different. b. Middle-size law firms would have a more important role in market, and a nice internal promotion system is the key element. c. Small-size law firms should seek chance to promote to middle-size one, otherwise, the price competition is unavoidable. d. The management models for law firms and patent firms/private notary are different, as the latter provides a less customized service.
