「宗教騙色」之性自主侵害

Abstract

本文嘗試整理說明部分宗教將性做為其教義中重要的一環，而從憲法宗教自由的角度應予保障，並且嘗試論述宗教自由基本權對於刑法的影響。本文認為此種影響在刑法行為人以宗教理由使被害人同意為性行為之所謂「宗教騙色」案件中，關鍵為於構成要件之解釋時考量宗教自由並尊重為同意者之性自主決定，以此反 對現行實務見解之論述模式。

This thesis indicated that sex is an important part of some religions, and it should be protect by freedom of religion. And discussed the influence of the religious freedom on the criminal law.
