我國家安全維護工作偵辦實務與判決研究－以反制中共滲透為例

Abstract

「沒有安全就沒有一切」，世界各國無不極力的對國家及國防之安全維護工作，盡最大的力量。防諜工作為確保國家安全之重要情報作為之一。近年來，兩岸交流活動熱絡，大陸地區人士申請來臺頻繁，社會已有戰火遠離之錯誤假象，導致國人心防漸失，忽略敵人對我國之威脅，而失去應有安全意識。而保護軍事、國家機密，直接關係到國家的生存與發展、戰爭的勝利與失敗，必須格外謹慎，故在國際社會中之間諜竊密活動，並不因社會情勢發展與敵、友關係之轉換而有所舒緩，是一場永不停止的無形戰爭。從近年國軍偵破敵諜案件研析顯示，中共對我蒐情竊密活動已變本加厲，影響我政治、經濟、國防等層面之安全，更應嚴肅面對與因應。 由於國家安全案件在實務上具隱密且蒐證不易之專業屬性，故過往學術界較乏系統性之理論研究，緣嘗試將國家安全案件實務與裁判進行彙編、整理，再藉由相關論文、書籍及網路等資料及資訊，歸納我國現行防諜工作之情報蒐集法源依據、機制及作法，以符合依法行政原則；另經由我國及國軍近年來發生之重大共諜案件加以分析整理，可進而瞭解發生共諜案之因素，並探究出我國現行防諜工作之情報蒐集機制上之問題，供我政府未來在制定、執行國家安全領域之政策與情報工作相關法制面參考。

“Nothing is more important than safety”, every country in the world makes the greatest efforts in ensuring the protection of their Nation and homeland security, and the prevention against espionage is one of the most crucial factors in National Security. In recent years, the cross-strait relations between Taiwan and mainland China has grown, as the exchanges between the two sides increases, the mainland Chinese frequently come to Taiwan for both travel or business purposes, causing the Taiwanese society to gradually let down their defenses, and forget to be aware and vigilant of national security threats in our everyday lives. This false sense of safety creates the illusion that the cross-strait war is a far away problem that cannot impact our daily life, which will in turn cause society to overlook the menace that the enemy poses on our country. The Safeguard of State and military secrets directly affect the results of warfare as well as the wellbeing and survival of a country, thus should be treated with the utmost caution, In the international activities of espionage, espionage infiltrations do not cease in regards to the development of social situations or the change in amities between countries, it is an invisible battle that never ceases. According to the analysis of recent Chinese espionage cases, it shows that Chinese espionage activities against Taiwan have been intensified, affecting the security of political, economic, defense and social levels in Taiwan. We need to face the issue more seriously. Due to the fact that cases involving National security are secretive and hard to prove in practice, thus in the past, the Academic circle have not been able to study this particular field intensively. Therefore in this study, National security cases are collected, analyzed, and with further research and internet searches, summed up to include the sources of law, mechanism and course of action of Counter Infiltration in our country, in accord to the principle of administration according to law. Also in analyzing major Chinese Espionage incidents directed against our Nation and military bases, we can further understand the principal cause of Chinese espionage activities, and the problems in the mechanisms of Counter Infiltration policies in Taiwan, further providing a reference for our government in future developments and executions of policies regarding the safeguard of National security and intelligence work.
