dc.description.abstract | 本研究探討中古時代的歐洲如何將基督教教義中,上帝的「慈愛」──亦即神愛世人的觀點──落實到具體的法制上,以及信仰上講求慈愛的立場,對中古法律所造成的影響。問題意識來自於宗教信仰觀點是貫徹宇宙人生的指導原則,信徒的道德觀、法律觀當與宗教觀一致,而非各自獨立的領域。論文共分為四章,前兩章為理念與觀點的釐清,呈現基督教強調慈愛的教義,對道德觀與法律觀的影響,後兩章經由教會法與世俗法律的實際內容,探討慈愛精神具體落實於法律上的情況。
第一章討論中古時期基督教信仰下的道德觀,透過古典時期倫理學到中古基督教信仰觀點下的發展與變化,呈現上帝信仰的出現使道德源頭、終極目的有進一步的探討,而神愛世人的教義使基督教道德觀有別於傳統或一般的道德觀念。第二章論述中古基督教神學的法律觀點,討論神學將法律的終極源頭訴諸上帝,並進一步詮釋古典時期的自然法觀念,成為最常被引用的法律原則與標準;在世俗法律的觀點上則呈現神學家對理想與現實的認知;而神學上與正義和慈愛相關的內容,如最後審判、煉獄、贖罪券與悔罪等,則和實際的法律規範難以二分。 第三章分別透過教會法的司法標準、司法程序、定罪與處罰三個部分,呈現教會法對慈愛精神的體現。法制合理性的提升及對弱者的救助為基督教精神的發揚,但在強調慈愛寬容的原則下,教會法無法堅守正義標準的隱憂與妥協之勢,則隨時間的發展而越趨明顯。第四章討論慈愛精神在世俗法律上如何落實,呈現神愛世人一義在早期蠻風未消之時,的確有使法律步向開化、更具合理性與人道精神的作用,但待中古中晚期,法律進一步發展後,救贖的觀點與慈愛內涵的模糊性,卻成為政治假藉宗教之名的合理化工具。 | zh_TW |
dc.description.abstract | This thesis is the study of the idea of “divine love” and the jurisprudence in the medieval Europe. The idea of divine love in Christianity leads to the emphases on mercy and forgiveness, whereas the main duty of jurisprudence is criminal punishment. Therefore, it has difficulty to carry out the idea of divine love on the jurisprudence because of the dilemma of mercy and justice, which is the main theme of this thesis. The first part of this thesis deals with how the teaching of Christian love affected the ideas of morality and law in medieval theology. The second part presents how the idea of Christian love being realized on the medieval jurisprudence, included canon law and secular law systems. | en |
