Abstract: | 近年來,企業們紛紛以專利訴訟作為市場競爭的手段,你來我往的專利大戰頻繁上演,一連串的訴訟更導致雙方的產品在部分地區禁售,越演越烈且代價驚人的專利戰,台灣廠商在這專利戰火四起的時代也無法倖免,許多大廠也常深陷專利戰,有鑒於專利爭議在台灣企業屢見不鮮,本研究將針對 4G LTE 專利聯盟的專利進行專利分析,暸解聯盟成員在 4G LTE 這項新興行動通訊技術的專利佈局,以進一步對台灣行動通訊產業成員提出建議,同時能作為台灣其他產業成立專利聯盟的參考。
過去有關專利聯盟的研究,包括專利聯盟形成的基礎、壟斷問題、運作制度的訂定、專利關係、專利策略和專利分析等。本研究著重於專利聯盟成員專利佈局的探討,利用統計分析方法、系統化整理與剖析專利資料成各種可分析、解讀的圖表訊息,以評估各 Via Licensing LTE 專利聯盟成員的研發能力與技術定位。 本研究整理出 Via Licensing LTE 專利聯盟的專利地圖,並且發現掌握大量專利的公司積極成立專利授權公司以創造附加價值及掌握少量專利積極參加專利聯盟以提高競爭力的現象。 In recent years, there are numerous ongoing patent wars between the world’s largest technology and software corporations. Firms increase market competition by means of patent litigation. As a result, rampant patent wars have ceased production and sale of the infringing product and caused great monetary damages to many firms. Firms in Taiwan can not immune from patent litigation in the age of patent war too, many of them have been in for a rough time. In order to provide high-tech industry in Taiwan with suggestion in formulating patent strategy, this thesis evaluates the pool members’ 4G LTE patent portfolio via patent analysis. Much of the research of patents pools to date has included the patent pool formation, the problem of monopoly, the determinants of licensing rules, patent strategy. This thesis mainly focuses on the estimation of R&D capability and technology position through patent analysis and depicts the result in a visual form of presentation. In addition, the research not only aims to explore the Vis Licensing LTE patent pool’s patent map, but also discover several trends of patent strategy including patent pool and non-practicing entities formation. |
