| dc.description.abstract | 本研究分析學術期刊在學術傳播系統的功能，並介紹學術期刊開放近用運動的意義、發展、影響，同時也指出學術期刊開放近用的二條主要路線：開放近用期刊及自我典藏各可能面臨哪些著作權法議題。本研究透過對於學術社群知識生產模式典範的觀察，指出學術知識生產在網路科技普及的數位化時代已有回復學術社群早期的共享典範，亦即在知識生產上朝向共享式同儕生產發展，而此生產模式卻與當代著作權法的立法假設有所衝突。因此，本研究一方面針對在我國著作權法架構下，學術期刊開放近用可能必須面對哪些著作權法議題進行分析，另一方面也分析美國著作權立法中關於數位圖書館、孤兒著作等相關著作權規範，期能對我國著作權法處理相關議題有所助益。 | zh_TW |
| dc.description.abstract | In this study firstly I analyze the functions of scholarly journals in the system of scholarly communication. Following that I provide an overview of the meaning, development of the Open Access (OA) Movement for scholarly journals and point out the implications of OA Movement and the possible copyright issues in the two major pathways of OA for scholarly journals. Based on my observation of the paradigm of production of knowledge in the scholarly community, I argue that the production of scholarly knowledge has been shifting towards the paradigm of commons-based peer production, which is similar to the norm of the scientific community. However, the current copyright regime which is largely based on the presumption that copyright law provides economic incentives for authors may not be a propeller but pose legal conflicts for the production of scholarly knowledge in an era that knowledge comes from commons-based peer production. I analyze the relating copyright issues arising from OA of scholarly journals under Taiwan copyright law. To shed lights on the application and reform of Taiwan copyright law on certain issues, I also analyze relating US copyright law and policy for reference. | en |
