立法院公費助理制度改革與法制化之研究

Abstract

本研究旨在探討我國立法院公費助理制度之現況、困境及法制化改革方向。緣於近年多起立法委員涉入助理費爭議，引發社會對立法委員助理制度之高度關注，顯示此制度存在法制不完備與運作不透明等問題。本文認為，立法院公費助理制度不僅為勞動法議題，更牽涉國會作為憲政機關之運作與立法權之穩定，是一項交織組織法、行政法與勞動法的多面向法制議題。 研究方法上，除回顧我國現行立法院公費助理制度之歷史沿革、法規規範及實務運作，亦廣泛蒐集並分析我國及美國國會助理制度之比較研究，並參考國內外相關立法與改革建議。本文亦結合研究者自身擔任立法院公費助理之經驗，剖析制度運作中的實際困境，包括助理工作內容模糊、專業需求高、待遇及工時不符勞基法標準、以及行政資源與立法院之資訊不對稱等問題。 研究結果指出，我國立法院公費助理制度目前雖已「條文化」，然在助理的職務定位、薪酬待遇、工時保障及專業化制度設計上仍顯不足。與美國制度比較後，可見美國國會助理制度在立法支援體系、薪資透明、進用程序及職務分工方面較為完善，並藉由立法重組法（Legislative Reorganization Act）、議員公務津貼制度（MRA/SOPOEA）、及眾多內部規章確立制度基礎，值得我國借鏡。 最後，本文提出漸進型、中度及重度三階段改革方案，從建立職位明確化與聘任登錄制度、設置倫理監督及申訴機制、導入證照制度，到制定《國會助理制度法》，藉此強化制度正當性與助理專業保障，並期望透過法制化與制度透明化，提升國會助理之勞動權益及立法品質，維護憲政秩序。

This thesis examines Taiwan’s public-funded legislative assistant system, focusing on its current status, challenges, and legal reform proposals. Recent scandals involving legislators’ misuse of assistant funds have highlighted institutional shortcomings and operational opacity. This study emphasizes that legislative assistants are not only a labor issue but also crucial to the Legislative Yuan’s constitutional functions. Using literature review, comparative analysis with the U.S. congressional staff system, and the author’s personal work experience, the thesis identifies problems such as unclear job definitions, low pay, long hours, and information gaps between the Executive and Legislative Yuan. In contrast, the U.S. system demonstrates clearer roles, better compensation structures, and stronger institutional support. The thesis proposes gradual, moderate, and comprehensive reforms, from clearer job definitions to the enactment of a Legislative Assistant System Act, aiming to protect assistants’ rights, improve legislative quality, and ensure constitutional governance.
