摘要: 在我國警察傳統的特別權力關係下,警察勞動權益長期被忽視,然而勞委會在民國90年首度拋出「警消不應被排除在工會法外」議題之濫觴,至近年來在警察權益促進團體的推動下,社會逐漸出現警察是否得以成立工會之討論,然而時至今日,警察工會政策仍然未能得到成功的推動。
本文旨在探討我國警察工會的政策推動需求與面臨之阻礙,以及是否可以利用第三方獨立機制作為政策的折衷方案,本研究利用深度訪談警察各階級之同仁及相關外部利益團體人員,輔以文獻爬梳行政部門對於警察工會之回應 ,綜整出警察內部有成立工會之需求卻也有內部的阻礙、外部行政機關堅定的反對及各自的政策回應以及第三方獨立機制之獲得普遍支持及制度設計上應著墨之處。
我國警察工會政策推動上似乎暫時被擱置,但警察相關勞動權益之保障不應因此而停擺,在此政策未能實現的現實下, 期許本研究之成果在未來的立法討論時能做為政策之參考。
Under Taiwan's traditional Special power relationship, police labor rights have long been neglected. However, in 2001, the Council of Labor Affairs first raised the issue that "police and firefighters should not be excluded from the Labor Union Law." In recent years, with the efforts of police rights advocacy groups, discussions about whether police should be allowed to form unions have gradually emerged in society. Nevertheless, the promotion of a police union policy has not yet been successful.
This thesis aims to explore the demand for promoting a police union policy in Taiwan and the obstacles it faces, as well as the potential for using a third-party independent mechanism as a compromise solution. Through in-depth interviews with police officers of various ranks and related external stakeholders, supplemented by a review of government responses to the police union issue, the study identifies both the internal demand for union formation and the internal resistance, along with the firm opposition from external administrative agencies and their respective policy responses. It also examines the widespread support for a third-party independent mechanism and key aspects of its design.
While the promotion of a police union policy in Taiwan seems to have been temporarily shelved, the protection of police labor rights should not stagnate as a result. In light of the current policy's unfulfilled status, this study hopes to provide valuable reference points for future legislative discussions.
