預防性切除乳房、卵巢及輸卵管之刑事責任研究

Abstract

關於預防性切除手術之刑事責任研究，國內目前僅有一篇相關文獻，然而隨著基因檢測日漸普及，預防性乳房、卵巢、輸卵管切除手術可能成為遺傳性乳癌或卵巢癌高風險女性之醫療選項。基此，本論文以安潔莉娜．裘莉預防性切除乳房、卵巢及輸卵管案及另一件預防性切除卵巢、輸卵管之案件—新光保險案為研究對象，透過分析臺灣預防性切除手術之判決，且整合國內外相關研究、文獻，並提出本文見解，以分析在臺灣施行預防性切除乳房、卵巢、輸卵管手術之醫師，何時得以業務上正當行為阻卻違法。

There has been only one study on the criminal liability of prophylactic surgeries in Taiwan; however, with the increasing popularity of genetic testing, prophylactic mastectomy and prophylactic salpingo-oophorectomy may become a medical option for women who are at high risk for hereditary breast or ovarian cancer. As such, the thesis analyzes the prophylactic mastectomy and prophylactic salpingo-oophorectomy case of Angelina Jolie and another prophylactic salpingo-oophorectomy case, the Shin Kong Insurance case. By analyzing the verdicts on prophylactic surgeries in Taiwan and integrating relevant domestic and foreign studies and literature, the thesis provides insights to analyze when a physician who performs prophylactic mastectomy and prophylactic salpingo-oophorectomy in Taiwan could be justified on account of proper behavior of occupation.
