影響性交易價格變數分析：以臺北市萬華區性工作者為例

Abstract

本文使用2018年至2022年間萬華地區查獲後以妨害風化罪嫌（違反刑法）移送之性交易案件進行分析，針對性工作者的背景因素或個人因素進行迴歸，將性交易視為一般經濟活動，討論影響性交易價格的相關變數。在樣本數有限的結果下發現，性交易方式、性工作者年齡、生理男性、抽成金額以及性交易鄰近地區在統計結果上影響性交易價格具顯著性，經濟學上也具實質影響性。其中，「半套」價格顯著較低、「養生館」與其他場所的性工作者在年齡、生理性別影響價格的結果不同，年長的養生館性工作者能得到較高的價格，而生理男性提供的性交易服務因供給少而推升價格。此外，抽成金額影響性交易價格顯著且穩定，抽成金額愈高，性交易價格亦隨之愈高；最後，在性交易鄰近地區部分可觀察到鄰近西門站的性交易價格高於龍山寺站。在司法實務現況中，除非涉及未成年、人口販運或違反性自主等重大犯罪議題，否則檢調多認定性交易為微罪，案件多被認定為「無被害人」犯罪，若能以「經濟活動」觀點出發，或許在管理、法制面上可提供不同思維，是為本文研究動機。

The study conducts an analysis of sex trade cases in Wanhua district between 2018 and 2022 that were investigated and prosecuted for the offense of obstructing public morals (contravening the Criminal Code). Through regression analysis of background and personal factors of sex workers, the study views sex trade as a general economic activity and discusses the relevant variables affecting sex trade prices. Despite the limited sample size, the results indicate significant influences on sex trade prices both statistically and economically. Forms of sex trade, age and biological gender of sex workers, commission amount and rate, and nearby areas of sex trade exhibit significant effects on sex trade prices and demonstates substantial impact on economics. According to the research, the price of "non-penetrative sex" services is considerably lower. Elder sex workers in massage parlour tend to get higher prices, and sex workers who are biological male receive higher price because of the scarce supply. In addition, commission amount also affect sex trade prices quite stably; for example, when commission gets higher, the trade price would be higher. Lastly, for nearby areas of sex trade, sex trade price is higher near Ximen Station compared to Longshan Temple Station. In current judicial practice, prosecutors mainly consider sex trade to be a minor crime, unless major criminal issues such as minors, human trafficking, or violation of sexual autonomy are involved. Such cases are mostly deemed to be "victimless" crimes. Treating them as "economic activities" may provide different thinking on management and legal aspects, which is the motivation of this research.
