dc.description.abstract | Judicial independence is considered and understood to be the important pillar of the rule of law and democracy, but in Thai case, it can be seen otherwise: the challenge to the rule of law and democracy itself. The Constitution of Thailand indeed provides safeguards for judicial independence, but they do not guarantee de facto independence.
Being seen as “having too much independence”, the courts and judges are alleged to have prejudicial, ideological, and political biases against political opponents of the Thai establishment and people who criticize and demand changes. As a result, the Thai judiciary can only be seen as independent from the people and the elected government. This raises the questions of its independence and impartiality; and particularly, the meaning of judicial independence. This study looks at the political crises in Thai contemporary politics which has been prevailed for almost two decades. It highlights Thai courts’ history, developments, role in the midst of political chaos. By uncovering and understanding the power relations in Thai politics, the judiciary’s relationships with other political actors, and the way in which the independent and powerful judiciary has been safeguarding and serving the newly constructed constitutional ideology and the interests of the Thai conservative establishment. These historical, cultural, and sociopolitical contexts will help us comprehend the conception of judicial independence and its paradoxical role in the context outside western liberal democracy. Finally, the thesis proposes suggestions for reforms and reconciliation that bring balance to judicial independence and accountability. | en |
