都更條例和危老重建條例下之合建策略探討：以S公司建案為例

Abstract

台灣都市老舊房屋林立且居住需求持續提升。政府25年前推出都市更新(都更)條例，改善居住品質也改善高房價問題，但因相關審核程序過於繁瑣，民國109年更推出程序相對簡化的都市危險老舊建築加速重建(危老)條例，期望可以藉此提升建商的誘因。許多建商認為都更和危老程序過於複雜而不願意承接相關案件，但其實都更和危老可大幅提升改建案的價值，塑造地主、建商、政府、社會共贏的局面。筆者2002年起投身建築產業進入S建設公司所屬營造廠，由工地現場工程師至今執掌品牌關係企業營運規劃之工作，本研究以S建設公司的兩個建案(A、B)為例，說明如何透過都更和危老整合和完成建案。

There are many old houses in Taiwan’s cities and demand for urban housing is also increasing. The government introduced the Urban Renewal Act more than 25 years ago to enhance living environments and lower housing costs, but review processes were overly complex. Therefore, the government introduced the Statute for Expediting Reconstruction of Urban Unsafe and Old Buildings in 2020 with simplified procedures to incentivize construction companies. Many companies are unwilling to participate in urban renewal projects or unsafe/old buildings reconstructions as they feel the procedures are too complicated. However, these projects can greatly increase the value of finished properties, creating a win-win situation for landowners, construction companies, the government, and society. The author entered the construction industry in 2002, working at S Construction Company as an on-site engineer and now working in operation and planning at a related enterprise. Two properties (A and B) of S Construction Company are used to illustrate how urban renewal or unsafe/old buildings reconstructions can enhance the value of and ensure successful completion of construction properties.
