摘要: | 不當勞動行為裁決制度自2011年施行以來,迄今已逾十年,累積案例數量眾多。其中涉及工會法第35條第1項第5款判斷者占七成以上,該條文之重要性不言而喻。基此,本文以裁決書與法院判決為對象,分析第5款之成立要件,同時就雇主支配介入行為予以類型化,再嘗試歸納第5款之審查基準。
藉由分析裁決書與法院判決之常見爭點,本文歸納第5款成立要件有四,包括主體、主觀意思、保護客體及何謂「不當影響、妨礙或限制」。在雇主支配介入行為樣態上,本文參酌第5款文義與目的解釋將之分為三類:一、對工會成立之支配介入;二、對工會組織之支配介入;三、對工會活動之支配介入。當中因為對工會活動之支配介入案件繁多,本文按支配介入之對象再分為三子類:一、單以勞工為對象,如會務假、不利益待遇;二、單以工會為對象,如反工會言論、拒絕工會協商、違反中立義務及雇主設施管理權;三、以勞工或工會為對象,如中止代扣工會會費、雇主監視行為、雇主訴訟行為及其他案件類型。最後,本文歸納實務對第5款之審查基準可分為四個面向,包括:破壞勞動慣行、違反正當權利行使原則、利益權衡及對工會活動造成不當影響、妨礙或限制。期許能供未來實務參酌,並建立雇主行為準則、減少不當勞動行為紛爭。 It has been more than ten years since the unfair labor practice was put in to effect on May, 2011. There are numerous cases and over 70% of them are relevant to Article 35, Paragraph 1, Subparagraph 5 of Labor Union Act. It shows the significance of Subparagraph 5. Based on the unfair labor practice decisions and court judgments, the thesis analyzes the constituent elements of Subparagraph 5, categorizes dominant intervention behaviors of the employers and summarizes the criteria of Subparagraph 5. By analyzing the common disputes of Subparagraph 5, there are four constituent elements, including subject, subjective elements, object and what is undue influence, impediment or restriction. Based on literal and teleological interpretation of Subparagraph 5, the thesis divides dominant intervention behaviors of the employers into three categories, the dominant intervention of labor union establishment, the dominant intervention of labor union organization and the dominant intervention of labor union activities. However, because of heavy cases of dominant intervention of labor union activities, the thesis divides it into three subcategories, including focusing on labors (leave of labor union cadres and unfair treatment), focusing on labor union (anti-labor union speech, rejection of labor union negotiation, breach of employer neutrality and facility management of the employer) and focusing on labors or labor union (withholding labor union dues, the surveillance of the employer, litigation actions of the employer and other types). Finally, this thesis summarizes four criteria of subparagraph 5, breach of labor habits, principle of properly exercising rights, balance of the interests and what is undue influence, impediment or restriction. The goals of the thesis are providing some practice advice, establishing the principle of employer behavior and reducing labor disputes. |
